Superior Court Los Angeles Guideline for Conservators

California law states that the Conservatee live in the least restrictive and appropriate home available that is in the Conservatee’s best interest and meets his or her need. In determining the Conservatee’s residence, financial realities must be considered. The Conservator plans carefully when making living arrangements so that once a plan is established, there are funds available to continue it so long as it meets the Conservatee’s requirements.


Conservatee should be able to:

Maintain adequate home security, such as: remembering to lock doors, turn off gas stove, shop, clean, and cook for him or herself or accept help. Perform personal care and grooming. Recall and report unusual occurrences to the conservator. A Conservatee may require assistance such as shopping, transportation to doctor’s appointments, by an independent care provider, neighbor, or family member.


Levels of Care

Independent Living (Retirement Residence) Conservatee should be able to:

Perform all personal care and grooming activities on his/her own. Keep medical appointments and self-administer all medications safely. Come and go as desired in the neighborhood without problems or risk. A retirement residence is defined as a hotel-type residence which generally provides meals, laundry, mail service, some medical transportation, and some group social activities.

Board and Care Home Conservatee should be able to:

Perform most of his personal care and grooming without help. Find his way around the facility and neighborhood without risk. A Board and Care home is a facility licensed to provide light custodial care and administration of medications to residents.

Skilled Nursing Facility Conservatee would most likely require a Skilled Nursing Facility if he or she is:

Unable to ambulate, or unable to understand his or her medical condition and manage his or her own medications, or forgetful or confused to the point of serious safety risk. A Skilled Nursing Facility, also known as nursing home or convalescent hospital, provides personal care, nursing care, and other medical services for persons who are substantially unable to care for themselves.
